Terms of Service

1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Storizee, operated from Ottawa, Ontario, Canada (“Storizee,” “we,” “us”). By creating an account, placing an order, or using Storizee (“Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. These Terms and the Privacy Policy form the entire agreement between you and Storizee regarding the Service, and supersede prior discussions on the same subject.
2. The Service
Storizee helps you create personalized illustrated storybooks from photos you upload, using automated tools including artificial intelligence. Features may include chat-guided story creation, digital reading, optional sharing, and ordering physical printed copies through third-party print-on-demand providers. We may change, suspend, or discontinue features at any time. We do not guarantee uninterrupted or error-free availability.
3. Accounts and eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or place an order. The Service is intended for adults who create content for children or others; accounts are not for children under 13 to create themselves. You must provide accurate registration information and keep your password secure. You are responsible for activity under your account. We may refuse registration, suspend access, or terminate accounts that violate these Terms or that we reasonably believe pose risk to the Service, other users, or third parties.
4. Your content (what you bring)
You keep what you already own. Photos, names, character notes, prompts, chat messages, and other materials you upload or type into the Service (“Your Content”) remain yours. You grant Storizee a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display Your Content only as needed to operate and improve the Service (including character detection, story generation, illustration, narration, share links you enable, customer support, quality review, and print fulfillment).
Rights and consent. You represent and warrant that:
- You have all rights needed to upload Your Content and to authorize our use as described in these Terms;
- For any photo of a child, you are the parent or legal guardian of that child, or you have obtained verifiable consent from the parent or legal guardian (and any other consent required by law);
- For photos of adults, you have their consent to use the photo for a personalized storybook;
- Your Content does not violate others’ privacy, publicity, or intellectual property rights, and is not unlawful or inappropriate for a family-friendly children’s product.
We do not claim ownership of your family photos or the personal identities depicted in them.
Storizee is intended for family-friendly, all-ages storybooks. You must not upload, submit, or request content that is sexually explicit, pornographic, or otherwise adult-oriented, or that is violent, hateful, harassing, exploitative, or otherwise inappropriate for children. We may refuse, remove, or decline to generate or print any such content and may suspend or terminate accounts that violate this rule.
5. Generated content and licenses (what the Service creates)
Stories, page text drafted by the Service, illustrations, layouts, cover designs, narration audio, print-ready PDFs, and similar outputs produced by or through Storizee (“Generated Content”) are created using our software, models, styles, and third-party AI systems.
You do not receive full ownership of Generated Content. Subject to these Terms and your payment of applicable fees, Storizee grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- View and enjoy your storybook digitally through the Service;
- Share a private or public link for personal, non-commercial viewing when you enable sharing;
- Order physical printed copies of your book for personal use (gifts for family and friends are fine) through Storizee’s checkout and print partners;
- Keep reasonable personal copies of a finished book (for example screenshots or a print you received) for private, non-commercial enjoyment.
This license is for personal, non-commercial use only, unless we agree otherwise in writing. Storizee and its licensors retain all other rights in Generated Content, the Service, brands, software, models, and visual styles.
Without our prior written permission, you may not:
- Sell, license, or commercially exploit Generated Content (including illustrations, full books, or page art) as products, stock assets, NFTs, or print-on-demand offerings outside Storizee;
- Use Generated Content to create a competing storybook or AI illustration service, or to train machine-learning models;
- Remove Storizee branding, watermarks, or notices from Generated Content where they appear;
- Bulk-download, scrape, or systematically extract Generated Content or other users’ content;
- Represent Generated Content as wholly created by you without Storizee when offering it commercially to third parties.
Buying generation credits or a printed book purchases access and fulfillment services under this license—not an assignment of all intellectual property in the illustrations or Service-created materials. If you need broader commercial rights (for example a school or brand partnership), contact us; we may offer a separate written license.
AI nature of the product. Stories, illustrations, and narration may be imperfect, unexpected, non-photorealistic, or stylistically different from your photo or from on-screen previews. Character likeness is an artistic interpretation, not a guarantee of exact resemblance. Output may vary between generations and may resemble other users’ results or third-party works. You are responsible for reviewing content before sharing or printing. We do not guarantee uniqueness, accuracy, or fitness for any particular purpose. Report concerns to us.
6. Credits and purchases
New accounts may receive a limited free generation allowance. Additional generation may require purchasing a digital product that includes generation credits. Credits are for use on the Service, are non-transferable, have no cash value, and are generally non-refundable except where required by law or as expressly stated in Section 9. Physical book orders are separate purchases and include shipping and third-party production costs as shown at checkout. Prices may change for future purchases; the price at checkout applies to that order. Applicable taxes may be calculated at checkout. You are responsible for any import duties, customs fees, or similar charges for international deliveries. Abandoned checkouts may expire as described at checkout and in product notices (typically after 24 hours).
7. Sharing
Books are private by default. If you enable a share link, anyone with the link may view the digital book under the same personal-use license in Section 5. You control whether others may purchase a print through Storizee. You are responsible for how you distribute share links. Sharing does not grant recipients commercial rights in Generated Content.
Allowing others to buy a print does not entitle them to anything beyond fulfillment of that print order. If you turn on “allow others to buy a print” (or a similar option), a person who buys a physical copy through a share link receives only the print-fulfillment service they paid for: production and shipment of that physical book under these Terms. Buyers create a Storizee account so they can track the order; that account does not grant ownership of the story, illustrations, or other Generated Content; generation credits for your book; digital access beyond what the share link already allows; rights to edit, re-share, or re-order indefinitely; commercial rights; or any ongoing relationship with you, except as a purchaser of that print (and ordinary account use of Storizee). You remain responsible for deciding whether to enable that option and for the consequences of distributing your share link.
8. Print orders
Physical books are produced and shipped by third-party print-on-demand partners. Production and delivery times shown in the product are estimates, not guarantees. Delays may occur due to printing, carrier networks, weather, customs, peak demand, or other factors outside our reasonable control. Color, paper, and trim can vary from on-screen previews; minor variance is normal and is not a defect. You are responsible for providing a complete and accurate shipping address. We and our partners are not responsible for loss or delay caused by an incorrect or incomplete address you supplied. Risk of loss passes when the order is delivered to the carrier or as otherwise set by the carrier’s rules, except where mandatory consumer law provides otherwise. Ordering a print does not expand your license beyond personal, non-commercial use of that physical copy (including gifting), unless we agree otherwise in writing.
Purchasers of a printed book are not entitled to anything beyond the physical book they ordered. Whether you ordered a print of your own story or bought a print from someone else’s share link, payment for a print purchases production and delivery of that physical copy only (plus any shipping you selected at checkout). A print purchase does not entitle the buyer to: ownership or assignment of intellectual property in Generated Content; source photos; an editable digital master; generation credits; free reprints or updates if the story later changes; account features belonging to the story creator; commercial exploitation rights; or any other goods, services, or licenses except those expressly granted in these Terms for personal use of the delivered physical copy. Except where mandatory consumer law requires otherwise, Storizee’s obligations to a print purchaser are limited to reasonable efforts to fulfill that order as described in these Terms and Section 9.
We may review orders for quality, safety, and compliance with these Terms and may refuse or cancel a print order that appears to violate them. If we cancel before production for a compliance reason and you have paid, we will refund amounts paid for that print order unless the cancellation results from your material breach (in which case we may refuse refund to the extent permitted by law).
9. Cancellations, refunds, and defects
Generation credits, AI-created digital storybooks, and physical books are personalized products made to your specifications. Except where required by law, the following rules apply:
- Credits and digital generation. Once generation has started or credits have been applied to create content, those purchases are generally non-refundable. If generation fails entirely due to a system error on our side, contact us and we will restore credits or re-run generation where reasonable.
- Print cancellations. You may request cancellation of a print order before it enters production at our print partner. Once production has started, the order generally cannot be cancelled.
- Print defects and shipping damage. If a physical book arrives with a clear manufacturing defect (for example severe misprint, binding failure, or damage in transit that is not your fault), contact us within 14 days of delivery with a description and photos. We may, at our option, reprint and reship or refund the purchase price of the defective book (and reasonable shipping where we are at fault).
- No refunds for AI artistic interpretation. We do not offer refunds solely because you dislike how AI illustrated a character, style, color, composition, or resemblance to a photo, or because of normal AI variance or minor imperfections inherent to generative art and print-on-demand. Review the digital book carefully before ordering a print.
- Our errors. If we made a clear fulfillment error (for example wrong shipping destination due to our mistake), we will work with you on a reprint or refund as appropriate.
Nothing in this section limits rights you may have under mandatory consumer protection laws that cannot be waived.
10. Acceptable use
You agree not to:
- Upload, generate, share, or request sexually explicit, pornographic, or adult content, or content that sexualizes minors in any way;
- Upload or request content that is extremely violent, hateful, harassing, illegal, or otherwise inappropriate for a children’s storybook product;
- Upload photos or materials you do not have rights or consent to use;
- Request or attempt to generate content that infringes third-party intellectual property—including copyrighted characters, logos, brands, or other protected marks— or that impersonates others in a misleading way;
- Use the Service for unlawful, abusive, or privacy-violating content;
- Attempt to disrupt the Service or reverse engineer systems beyond what the law allows;
- Scrape or bulk-export content, or misuse Generated Content in ways prohibited in Section 5;
- Circumvent usage limits, payment, or security measures, or create accounts to evade a suspension.
We may remove content, refuse generation or print fulfillment, and suspend or terminate accounts for violations of these Terms, including this section. We are not obligated to monitor all content but may review content for safety, quality, and compliance.
11. Third-party services
The Service relies on third parties such as payment processors (e.g. Stripe), AI providers, hosting providers, and print-on-demand and shipping partners. Their services are subject to their own terms and privacy policies. We are not responsible for outages, delays, or acts of third parties beyond our reasonable control, except as required by law.
12. Disclaimers
THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that Generated Content will meet your expectations or be free of AI artifacts.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STORIZEE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, STORIZEE’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, fraud, gross negligence, or certain personal injury claims under Canadian law).
14. Indemnification
You agree to indemnify, defend, and hold harmless Storizee and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content or how you use Generated Content; (b) your violation of these Terms; (c) your violation of any third-party right, including privacy, publicity, or intellectual property rights; or (d) your violation of applicable law. We may assume exclusive defense of any matter subject to indemnification; you will cooperate reasonably.
15. Force majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government action, epidemics, infrastructure or power failures, internet or third-party service outages, or carrier disruptions.
16. Termination
You may stop using the Service at any time. You may delete your account in Account settings at any time; deletion removes your story library, photos, and related personal content subject to our Privacy Policy (including retention of payment and fulfillment records where required). We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive (including licenses already granted for fulfilled personal use of a physical book you received, ownership and IP reservations, disclaimers, liability limits, indemnification, and dispute terms) will survive. We may delete or disable access to account content after termination subject to our Privacy Policy and legal retention needs.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your place of residence require otherwise. Subject to those mandatory laws, you and Storizee agree that the courts of Ontario (including the courts sitting in Ottawa, Ontario) have exclusive jurisdiction over disputes arising from these Terms or the Service, and you consent to personal jurisdiction there. Before filing a formal claim, you agree to contact us at the email below and attempt to resolve the dispute informally for at least 30 days. Nothing in this section limits any rights you may have under applicable Canadian consumer protection legislation that cannot be waived by contract.
18. Changes
We may update these Terms. We will revise the “Last updated” date and, for material changes, provide additional notice in the product or by email when feasible. Continued use after changes take effect constitutes acceptance of the updated Terms, except where applicable law requires a different process.
19. General
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
